HEDDEBSOU, Judge.

Appellant was convicted of murder in the second degree, and his punishment assesséd at confinement in the penitentiary for a term of five years.

The evidence, in effect, shows that deceased, Spencer Davis, and Littleton Pollard, the father of appellant, had a difficulty on Monday, February 18, 1901, in which Littleton was worsted..
