This is an action to determine the respective liability of National Surety Corporation, 1 and Western Fire & Indemnity Company, 2 under their respective policies of liability insurance, issued to W. E. Bryan and C. L. Hoffman, doing business as Bryan & Hoffman, Contractors, 3 for an amount paid under a compromise settlement of an action on a claim for personal injuries, by one Tyler against Bryan & Hoffman, arising out of a collision between an automobile driven by Tyler and a water truck driven by one Cooper, acting as an employee of Bryan & Hoffman, on a road…
