This action was commenced in the district court of Blaine county, by the defendant in error, First National Bank of Okeene, as plaintiff, against the plaintiff in error, J. H. Sei-bert, and one B. H. Horn, as defendants, to recover the pos-, session of about 3,500 bushels of wheat. The plaintiff based its right of possession upon a chattel mortgage. The defendant Seibert answered, setting up a claim to the wheat and right of possession based upon a chattel mortgage later in date than that of the plaintiff, but he claimed that the first mortgage did not cover the same wheat, and that therefore…
