On August 8, 1967, Charles A. Gray, was charged by information filed in the district court of Hill County with the crime of burglary in the nighttime in Count I and with grand larceny in Count II. The defendant pleaded “not guilty” to both counts. On November 29, 1967, a hearing was held on the defendant’s motion to discover and suppress, evi denee which motion was denied at the commencement of the trial on December 11, 1967.
