OPINION OF THE COURT

COOK, Judge:

In this case we are confronted with the issue of the witness located in the United States who is unwilling to travel overseas to testify at a court-martial.

The accused was tried by a general court-martial convened in the Republic of the Philippines, for conspiracy to commit larceny, larceny and burglary, in violation of Articles 81, 121 and 129, Uniform Code of Military Justice, 10 U.S.C. §§ 881, 921 and 929, respectively.
