The plaintiffs instituted suit in the Circuit Court of the State of Oregon in and for Washington County, for the purpose of securing a decree for the specific performance of an alleged oral contract relating to the devise of real property by will. 1. The defendants assert that the complaint is insufficient in that it fails to aver an adequate consideration for the agreement alleged to have been made by plaintiffs with Benjamin Scholfield.
Paragraph XVT of the complaint avers the principal consideration for the contract involved in this suit. This averment has already been set out in full herein, and it is unnecessary to repeat it.
