Plaintiff Danil Apokarina (“plaintiff’) is a permanent resident of the United States. On June 27, 1996, the Immigration and Naturalization Service (“INS”) began removal proceedings against plaintiff based on plaintiffs criminal convictions. On February 23, 1999, while the removal proceedings were still pending, plaintiff submitted a petition for naturalization.
