MEMORANDUM

MOTZ, Chief Judge.

Petitioner Albert Agha Ngwana appeals the United States Immigration and Natu ralization Service’s (“INS”) denial of his application for naturalization as a citizen of the United States. Respondents the Attorney General of the United States and the District Director of INS have filed a motion to dismiss or, in the alternative, to hold the case in abeyance. For the reasons stated below, the motion will be denied.
