This action was commenced by Herman Seibold, plaintiff and appellant, in the district court for Frontier county, against Fred Whipple, defendant and appellee, for the purpose of restraining and enjoining the defendant from obstructing the natural flow of water from Clifford Canyon and two ravines adjacent thereto and diverting said waters onto the land of the plaintiff by a ditch, and for an order requiring the defendant to remove the dam or embankment at the mouth of Clifford Canyon and to fill the ditch and to recover damages that plaintiff’s land has sustained by reason thereof.
