An injunction was applied for to restrain defendant from diverting surface water onto plaintiff’s premises, and, from an order denying the application and dismissing *208the action, the latter appeals. The plaintiff and defendant own adjoining quarter sections of land with a public highway running between. The plaintiff’s land lies to the west of the defendant’s, the county occupying its land as a “poor farm.” A liberal quotation from the decision of the trial court will conduce to a more intelligent understanding of the case and of the legal propositions to be considered.
