Reinhard, J. —

This action was instituted by the appellee against the appellant, a street railway company in *48the city of Indianapolis, for the alleged negligent killing of appellee’s son, eleven years old, who, at the time, was riding in an open vehicle, drawn by one horse, in company with two other persons, one of whom was the driver.

The court overruled a demurrer to the amended complaint, and this ruling constitutes the first error assigned and discussed.

It is averred, in the complaint, that the appellant owned and was operating a street railroad in the city of Indianapolis, Indiana, one…
