INTRODUCTION
This is an action by the State of New York for cost recovery and equitable relief brought pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”), 42 U.S.C. § 9601 et seq. In March, 1994, the State filed a motion for partial summary judgment under Fed. R.Civ.P. 56.
