At the close of the evidence plaintiff took a compulsory nonsuit, which the' circuit court refused to set aside, and hence this appeal.

The plaintiff is a corporation owning and operating at Kansas City a depot with the necessary buildings, sheds, tracks and offices, all designed to accommodate the different railroads at that place.
