Two-year-old Kailyn Marie Montgomery died in her home while under the care of appellant Kyle John Kelbel. Following Kailyn’s death, Kelbel was convicted of first-degree murder, past pattern of child abuse, in violation of MinmStat. § 609.185(5) (2000), and second-degree murder, in violation of Minn.Stat. § 609.19, subd. 2(1) (2000). He was sentenced to life in prison.
