Gerardo Jesus Herrera (“Gerardo Herrera”) brought a § 1983 claim against two San Antonio police officers and three employees of the Bexar County District Attorney’s Office. Gerardo Herrera alleged that his due process rights were violated when he was arrested and incarcerated for several days for a crime that he did not commit. After discovery, the district court granted the defendants’ motion for summary judgment.
