Appeal from a judgment of the superior court for Spokane county, Gilliam, J., entered September 18, 1906, upon findings entered in favor of the plaintiff, in an action for breach of warranty.

The respondent brought this action in the court below to recover damages for an alleged breach of warranty of a set of scales for weighing meats. The cause was tried to the court without a jury, and findings and a judgment were entered for the plaintiff as prayed for. Defendants appeal.
Upon the trial the court found the facts substantially in accordance with the allegations of the complaint, the material findings being as follows:
