OPINION
NANGLE, District Judge.
In this action, plaintiff Consolidated Grain and Barge Company, Inc. seeks to recover damages sustained when its barge was damaged by ice.
Having tried the case sitting without a jury the Court makes the following findings of fact and conclusions of law:
FINDINGS OF FACT
1. Plaintiff Consolidated Grain and Barge Company, Inc. is a corporation organized and existing pursuant to law. At all times material herein it was the owner pro hac vice of Barge ABS-1444B, a .box-type barge, having a square bow and stem.
