THIS MATTER comes before the Court on the Defendant’s Motion for Summary Judgment (Doc. No. 8) and the related briefs and filings. For the reasons set forth below, the Court will DENY the Defendant’s motion.

I. BACKGROUND

Donald Webb’s tractor trailer overturned on a clover-leaf interstate exit ramp near Columbia, South Carolina. The accident caused him injuries. His employer, K.R. Drenth Trucking, Inc.
