BERRIGAN, District Judge.

Before the Court are cross-motions for Partial Summary Judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. For the following reasons, both motions are DENIED.

Background

Kenneth M. Boudreaux and William J. Nolan (collectively “Plaintiffs”) worked for Banctec, Inc. (“Defendant”) as computer repair technicians (“CRT”). Defendant assigns computer-repair work, or “service calls,” to its various CRTs who work out of their home offices.
