Plaintiff filed a bill for divorce against defendant Elmore L. Westgate and November 30, 1938, obtained a decree, which was affirmed by this court November 9, 1939 (Westgate v. Westgate, 291 Mich. 18).

By paragraph 11 of the decree for divorce it was provided plaintiff should have a one-half interest in all of the properties of the Direct Befinery Stations; and a one-half interest in all properties owned by defendant, the ownership of which remained undisclosed.
