Defendant Charles Dodds appeals from an order of the circuit court dismissing, without an evidentiary hearing, his petition for post-conviction relief filed pursuant to the Post-Conviction Hearing Act (Act) (725 ILCS 5/122 — 1 et seq. (West 2000)). Defendant also appeals from the same order in which the trial court denied his motion for a new trial pursuant to section 2 — 1401 of the Code of Civil Procedure (Code) (735 ILCS 5/2 — 1401 (West 2000)).
