The petitioner seeks to have reduced or declared void the 1939 assessment upon its real property in the city of Rochester and a writ of certiorari to review such assessment has been granted. The appellants moved to dismiss the writ upon the ground that the petitioner had not appealed to the board of assessment review of the city of Rochester which had power to grant the relief sought.

The petition for a writ of certiorari to review an assessment upon real property must show “ that the application has been made in due time to the proper officers to correct such assessment.” (Tax Law, § 290.)
