Habéis, J.

On August 25, 1941, while he was a passenger in an automobile which was traveling on a county highway in the County of Oneida, the plaintiff’s intestate, then a youth of fourteen years, met his death through an accident. The accident came about through the automobile’s leaving the road and hitting a tree which was located near the road. The plaintiff-respondent here in his complaint claims that such accident occurred because of the negligent construction and maintenance of such highway.
