OPINION

NYE, Justice.

Plaintiff Kate Howard Usher filed suit against defendant Glass Sorenson & Mc-David Insurance Company, an insurance agency, for the return of premiums collected by them, alleging that defendant conspired with certain other defendants to cheat and defraud the plaintiff. The trial court granted defendant’s motion for summary judgment. Plaintiff has perfected her appeal to this court.
