MEMORANDUM OPINION

BLACKWELL N. SHELLEY, Bankruptcy Judge.

This matter came before the Court upon the motion of the plaintiff, Framingham UAW Credit Union (“Framingham”), to amend its complaint and upon the motion of the defendant, John Edward Kelley (“Kelley”), for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. Upon the filing of appropriate responses to the respective motions before the Court, a hearing was held on October 23, 1984 at which time the Court heard argument of counsel. At the conclusion of the hearing the Court took the matter under advisement.…
