MEMORANDUM OPINION AND ORDER ON DEFENDANT’S MOTION TO DISMISS

This matter is before the Court on motion of the Debtor-Defendant, Daniel L. Barnes (“Debtor”) to dismiss the Amended Complaint of Re/Max Properties, Inc. (“Re/Max”). The Amended Complaint seeks a determination of nondischargeability of a debt under § 523(a)(2)(A) of the Bankruptcy Code, Title 11 U.S.C.
