I. Introduction
Pursuant to the Labor-Management Reporting and Disclosure Act of 1959 (“LMRDA”), 29 U.S.C. § 401 et seq., plaintiff J.W. Pruitt, Jr. (“Pruitt”) brought this action against his local and national union. Pruitt alleges that, in retaliation for his exercise of rights protected by the LMRDA, the national union placed his local under trusteeship and prevented him from assuming an elected position as a business representative.
