Appellant, Bobertson, instituted this suit originally in the Justice’s Court, against appellee, Ellis County, to recover a balance of $157, alleged to be due him for services rendered as official stenographer of the District Court of said county. He obtained judgment in the Justice’s Court for the amount sued for, and appellee appealed the cause to the County Court of said county, where it was tried de novo without a jury, resulting in a judgment that appellant take nothing and appellée recover its costs.
