This case comes before the court on defendant’s motion, filed January 7, 1974, for judgment requesting that the court adopt, as the basis for its judgment in this case, the recommended decision of Trial Judge Philip R. Miller, filed November 14, 1973, pursuant to Rule 134(h), plaintiffs having failed to file a notice of intention to except thereto as provided by Rule 141(a) and the time for so filing pursuant to the Rules of the court having expired.
