Appeal from an order of *986the Supreme Court (Dier, J.), entered July 23, 1998 in Warren County, which denied defendant’s motion for summary judgment dismissing the complaint.
At all times relevant to this appeal, defendant was the owner of certain real property located in the Town of Bolton, Warren County. In early 1995, plaintiff learned that defendant’s property was for sale and negotiations to purchase the property ensued.
