KBG Holding Corporation (KBG) initiated this action seeking the release of money deposited in the form of International Money Orders (IMOs) in its account at Union Bank & Trust Co. (Union Bank). Union Bank filed a counterclaim against KBG, Komplett Bautraeger Ges. m.b.H. (KBG-Austria), Transphor, Inc., Ronald A. Laos, and Walter 0. Knapp seeking damages and a permanent injunction imposing a constructive trust on funds Union Bank exchanged for IMOs that were determined to be counterfeit.
