Appeal from District Court, Wichita County; E. W. Nicholson, Judge. Suit by J. E. Frazier against the Ft. Worth & Denver City Railway Company. Judgment for actual damages and for a penalty, and the defendant appeals from the judgment imposing a penalty.

At about 3 o’clock in the afternoon of June 6, 1915, which was Sunday, J. E. Frazier purchased from the station agent of the Ft. Worth & Denver City Railway Company at Wichita Falls a ticket over said railroad from Wichita Falls to Ft. Worth, Tex. At that time his residence was in Cooper, Tex.; but he had been visiting his daughter, Mrs. Archer Denny, and her family, who resided in Vernon, Tex., and on the day he purchased the ticket he had come from Vernon to Wichita Falls with his daughter and her husband in an automobile.
