Westlake Ethylene Pipeline Corporation (Westlake), a “common carrier” pipeline transporting ethylene in Texas, appeals the district court’s final judgment affirming a final order of the Railroad Commission of Texas concluding that Westlake’s 2013 tariff is discriminatory and may not be enforced. See United Gas Corp. v. Shepherd Laundries Co., 144 Tex. 164, 189 S.W.2d 485, 489 (1945) (noting that under common law, common carriers may not unjustly discriminate).
