delivered the opinion of the court:

Defendant was indicted for two counts of aggravated battery and one count of attempt murder. After a jury trial, defendant was convicted of both counts of aggravated battery and was sentenced to serve a 3- to 9-year term of imprisonment.

The evidence revealed that at approximately 6 p.m. on May 25, 1973, Frank Knutell, a Lake County deputy sheriff, driving an unmarked car, arrived at defendant’s Zion home to serve defendant with a summons, an injunction writ and a motion notice. Dressed in a business suit, Knutell went to…
