MEMORANDUM OPINION
ERWIN, Chief Judge.
This matter is before the court upon both plaintiffs’ and defendants’ motions for partial summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. The plaintiffs moved for partial summary judgment on the issue of vicarious liability against Dallas Carrier Corporation (DCC) for the conduct of defendant Raymond Smith (Smith). The defendants’ Rule 56 motion addressed the question of whether or not the plaintiffs are entitled to punitive damages.
