This is an action at law upon a policy of accident insurance by Etta Carpenter, the beneficiary named therein. The amended petition sets forth the making and delivery of the policy of insurance by the defendant “on or about the 28th day of March, 1932,” in which defendant agreed to pay plaintiff $10,000 in the event of the death of Harry Lyman Carpenter (the husband) “provided said death was caused solely and exclusively by bodily injury sustained solely through accidental means.” A copy of the policy is attached to and forms a part of the petition.
