On November 22, 1922, the defendant insurance company, upon an application made by James A. Rogers, insured his life in the sum of $1,000; the policy being made in favor of his estate. At a later date, December 9, 1922, he assigned this policy to his brother, W. S. Rogers, but it seems that no cop}r of this assignment was sent to the company, as required’ by the policy, although W.
