Plaintiff, hereinafter referred to as the Oil Company, brought this action to recover upon a surety bond in the sum of fifty thousand dollars, executed by the defendant Pacific Surety Company, hereinafter called the Surety Company, and upon an agreement executed by Carl Leonardt, hereinafter called the indemnitor, to indemnify the Surety Company.
