This is a suit to recover a money judgment against the defendants. The complaint is couched in three counts. Plaintiff levied an attachment upon personal property belonging to defendants. A demurrer to the complaint was sustained, without leave to amend, on the ground *817that plaintiff lacked legal capacity to sue. The action was dismissed and the attachment was released. From the order dismissing the action and discharging the attachment the plaintiff appealed.
