The appellant, Lester A. Barrer, brought this action against Women’s National Bank (“the Bank” or “WNB”) for damages he allegedly sustained as the result of the Bank’s eleventh hour decision to rescind a loan agreement. WNB defended and moved for summary judgment on the ground that Barrer had made innocent material misrepresentations in his loan application that justified the Bank’s avoidance of the contract.
