Appeal by the plaintiff, George C. D’Arey, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the loth day of July, 1902, upon the dismissal of the complaint by direction of the court after a trial at the New York Trial Term.

Patterson, J.:

The plaintiff appeals from a judgment dismissing the complaint in an action brought to recover damages for injuries alleged to have been sustained by him through the negligence of the defendant. He was a passenger on a car of the defendant operated by an overhead trolley wire. It was a closed car and the plaintiff was standing on the rear platform. The car was moving south from Mt.
