MEMORANDUM
SPENCER, District Judge.
This case originated with the installation of allegedly defective windows in a Portsmouth, Virginia apartment building owned by Crawford Harbor Associates. Crawford Harbor sued the general contractor (“Blake”), who in turn filed a third-party action against the window installation subcontractor (“Walker”) and against Wallace-Crossly Corporation, a Florida corporation which is alleged to be the successor in interest to the entity that originally manufactured and warranted the windows in question.
