OPINION

HEWITT, Judge.

This case is before the court following a trial on damages. In a previous opinion, this court held that the contract between plaintiff Westfed Holdings, Inc. (Westfed) and defendant, under which defendant agreed to forbear from imposing certain regulatory capital maintenance requirements on the merged entity Western Federal Savings and Loan Association, was breached by the passage of the Financial Institutions Reform, Recovery and Enforcement Act of 1989, Pub.L.
