Presently pending and ready for resolution in this employment discrimination case brought under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000(e), et seq. (“Title VII”) and the Rehabilitation Act of 1973, as amended, 29 U.S.C. §§ 701-797 (“Rehabilitation Act”), is the motion to dismiss or for summary judgment of Defendant Donald Rumsfeld, Secretary of the United States Department of Defense (“DOD”).
