The petitioner, Stefon Morant, appeals from the judgments of two trial courts, one judgment denying the second count of his second amended petition for a new trial and the other denying his fifth amended petition for a new trial. The petitioner claims on appeal that the court, Hon. William L. Hadden, Jr., judge trial referee, improperly denied the second count *139of his second amended petition, which was based on allegedly newly discovered evidence.
