I. INTRODUCTION
Plaintiff Medtronic, Inc. (“Medtronic”) filed its complaint for declaratory judgment of non-infringement and invalidity of United States Patent Nos. RE 38,119 (“the '119 reissue patent”) and RE 39,897 (“the '897 reissue patent”) on December 17, 2007, naming as defendants Boston Scientific Corporation (“BSC”), Guidant Corporation (“Guidant”), and Mirowski Family Ventures LLC (“MFV”). 1 (D.I. 1) Med-tronic’s complaint contains a jury trial demand.
