This is a statutory quo warranto action brought by the State of Alabama on the relation of John Allie James challenging the qualifications of Thomas Reed to hold office as a member of the Alabama House of Representatives. The Circuit Court of Montgomery County granted a motion for summary judgment, holding that the judiciary has no authority to determine the qualifications of a member of the Alabama Legislature. We reverse.
