DANIELS, District Judge.

This action was referred to Magistrate Judge Frank Maas for a Report and Recommendation (“Report”) on defendants’ motion for summary judgment pursuant to Fed.R.Civ.P. 56. Magistrate Judge Maas issued a Report wherein he recommended that defendants’ motion for summary judgment be granted. In his Report, Magistrate Judge Maas advised the parties that failure to file timely objections to the Report will constitute a waiver of those objections.
