MEMORANDUM

MERHIGE, District Judge.

A.J. Wenzler, a Virginia state prisoner proceeding pro se and in forma pauperis, brings this 42 U.S.C. § 1983 action. He seeks injunctive relief. The defendants have moved to dismiss pursuant to Fed.R.Civ.P. 12(b)(6). Jurisdiction is áppropriate pursuant to 28 U.S.C. § 1343(a)(3).

STANDARD FOR A MOTION TO DISMISS

Rule 12(b)(6) allows a court to dismiss claims based on dispositive issues of law. Hishon v. King & Spalding, 467 U.S. 69, 73, 104 S.Ct. 2229, 2232, 81 L.Ed.2d 59 (1984). A 12(b)(6) motion cannot be granted as a matter of law unless “it is clear that…
