MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

Plaintiff Wladyslaw Gladysz (“Gladysz”) sued Raymond J. Donovan (“the Secretary”) and the United States Department of Labor, Employment and Training Administration seeking declaratory and injunctive relief from denial of labor certification pursuant to 8 U.S.C. § 1182(a)(14). 1 Presently before the Court are the parties’ cross-motions for summary judgment.
